Court Order for Mobility Business

Thanks to joint investigations by the Trading Standards Services of Warwickshire and Coventry an interim injunction has been handed down to Amarjit Gill, trading as ABM Mobility at Unit 2 Gainsborough Close, Long Eaton, Derbyshire NG10 1PX.

The injunction, obtained by Derbyshire County Council’s Trading Standards Service, requires Gill to trade fairly and legally. In handing out the injunction the Judge warned Gill any further breaches of trading law might result in him being sent to prison.

The injunction was sought after elderly and vulnerable residents of Coventry and Warwickshire became the target of ABM Mobility, which supplies mobility aids and wheelchairs, leading to 50 complaints in just two days.

Trading Standards Officers received numerous complaints from consumers alleging they had been led to believe ABM Mobility was associated with Social Services or Occupational Therapy. A number of people were called by telephone despite being registered with the Telephone Preference Service and some consumers complained salespeople had spent three hours trying to clinch deals. Unbelievably, one consumer was even driven to the bank to withdraw a large sum of money.

Evidence gathered in Warwickshire and Coventry formed part of Derbyshire County Council’s application for the injunction. A breach of the injunction would result in Gill being taken before the Court to face proceedings for contempt, which could lead to imprisonment for up to two years.

Warwickshire County Councillor Richard Hobbs, Portfolio Holder for Community Protection said "Tough action is needed to protect our elderly and vulnerable residents from rogues like Gill. This is certainly an excellent example of joint working in action where Trading Standards from different Authorities successfully work together in the interests of our consumers. We will be watching Mr. Gill closely and will not hesitate to take further action if he breaches the terms of his injunction“.
